Judge denies Jose Andres’s request to throw out Trump lawsuit
Like an under-cooked souffle, the legal battle between Washington-based celebrity chef Jose Andres and real estate mogul Donald Trump isn’t done yet.
A D.C. superior court judge on Friday denied a request by Andres to essentially throw out the breach-of-contract lawsuit, which Trump filed after Andres backed out of a deal to open a Spanish-themed eatery in Trump’s Washington luxury hotel complex. Andres nixed plans to open the restaurant in Trump’s development after the hotelier-turned-GOP presidential candidate made controversial comments about Hispanic immigrants.
On Friday, Judge Jennifer Di Toro turned down Andres’ request for a partial summary judgment. “Substantial material facts in dispute remain regarding the effect of Mr. Trump’s statements,” she wrote.
